Summary of the House Committee Version of the Bill

SB 254 -- PRESCRIPTION MEDICATION IN SCHOOLS

SPONSOR:  Engler (Tilley)

COMMITTEE ACTION:  Voted "do pass" by the Committee on Crime
Prevention and Public Safety by a vote of 12 to 0.

This bill prohibits persons under 21 years old from possessing or
distributing a prescription medication on school property without
a valid prescription.  Possession of the medication is a class C
misdemeanor; a second or subsequent offense is a class B
misdemeanor.  Distribution of the medication is a class B
misdemeanor; a second or subsequent offense is a class A
misdemeanor.

FISCAL NOTE:  No impact on state funds in FY 2006, FY 2007, and
FY 2008.

PROPONENTS:  Supporters say that drug use is down with all of the
illegal drugs, but now there is a growing problem with teenagers
using prescription medications.  The bill will allow school
officials to get these teenagers into the justice system, so that
they can get some help.

Testifying for the bill was Senator Engler.

OPPONENTS:  There was no opposition voiced to the committee.
